Course Description

With the SALT deduction now repealed, clients in high income tax states are looking for ways to reduce their overall tax burden.  An “ING” is a way to use trusts to avoid paying state income tax on passive investments and certain capital gains in high income tax states. This course will examine the ING structure and how to achieve that result.

Anthony F. Vitiello is the chairman of the Taxation and Estate Planning Group at Connell Foley LLP. His practice is limited to tax planning for individuals, businesses, estates, and trusts, emphasizing estate planning, and asset protection planning. Mr. Vitiello also maintains a significant practice in gift and estate tax audits and controversies.

Mr. Vitiello has been recognized in the 2011 through 2017 editions of Best Lawyers® (in the areas of Trusts and Estates, Tax Litigation and Controversy and Trusts and Estates Litigation). Best Lawyers is one of the most well respected and long-standing peer-review publications in the legal profession. In the December 2005–2008 editions, all years of its publication, Mr. Vitiello was named by the editors of Worth magazine in its list of the nation's 'Top 100 Attorneys'. Worth's editors looked most carefully at attorneys specializing in trusts and estates and other personal planning matters.

Mr. Vitiello has lectured extensively and published on estate planning, and related tax matters, including authoring the chapter on Grantor Retained Annuity Trusts in the American Bar Association’s 2011 publication, The ABA Practical Guide to Estate Planning. He is also certified to provide continuing professional education credits to certified public accountants in New York and New Jersey and those individuals holding the certified financial planner designation.

Mr. Vitiello received his law degree and masters of law (LL.M.) in taxation from New York University. He began his career with the United States Treasury, where he provided legal counsel to the Internal Revenue Service.

Mr. Vitiello is admitted to practice law in seven states and maintains a national practice in federal estate and gift tax planning for high and ultra-high net worth individuals. His full biography, along with links to his published articles and lectures, can be found at:
