Refund opportunities abound with the new Net Operating Loss (NOL) rule changes in the CARES Act.
The NOL deduction has been dramatically changed by the CARES Act for taxpayer losses in 2018, 2019, and 2020. Major refund opportunities exist for many taxpayers to carryback NOLs for 5 years to as early as 2013 to obtain refunds for taxes paid at likely higher tax rates especially for C Corporations at 35%.
The focus will primarily be on the CARES Act NOL changes and practical guidance on procedures for obtaining refunds and expediting refunds including the expanded eligibility for “quick refunds” using Forms 1045, Form 1139. The newest Revenue Procedure will be discussed as well as which entities qualify for the new NOL rules.
The more restrictive NOL rules under the Tax Cuts & Jobs Act will also be discussed. Those TCJA rules have been delayed but still impact NOL calculations as well as loss limits for tax years 2021 and beyond.
